Welcome to Vaastu App. These Terms of Service ("Terms") govern your use of our mobile application and website (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services. Please read these Terms carefully before using the Vaastu App.

1. Acceptance of Terms

By creating an account, downloading our app, or using our Services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Vaastu App provides: (a) AR-based room scanning and analysis using your device's camera and sensors. (b) Vaastu Dosha detection based on traditional Vaastu Shastra principles. (c) Personalized remedy recommendations and reports. (d) Educational content about Vaastu Shastra. (e) Premium features available through subscription. Our Services are provided for informational and educational purposes only. The analysis and recommendations are based on traditional Vaastu Shastra principles and should not be considered as professional architectural, medical, financial, or legal advice.

3. User Accounts

To access certain features, you must create an account. You agree to: (a) Provide accurate, current, and complete information during registration. (b) Maintain and promptly update your account information. (c) Keep your password secure and confidential. (d) Accept responsibility for all activities that occur under your account. (e) Notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. User Responsibilities and Conduct

You agree not to: (a) Use the Services for any unlawful purpose or in violation of any applicable laws. (b) Attempt to gain unauthorized access to our systems or other users' accounts. (c) Interfere with or disrupt the Services or servers connected to the Services. (d) Use automated means (bots, scrapers) to access the Services without our permission. (e) Transmit viruses, malware, or other malicious code. (f) Harass, abuse, or harm other users. (g) Impersonate any person or entity. (h) Use the Services to generate spam or unsolicited communications. (i) Reverse engineer, decompile, or disassemble any part of the Services.

5. Intellectual Property Rights

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof, are the exclusive property of Foundational Creations or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our Services without our prior written permission. The Vaastu analysis algorithms, remedy databases, and AR technology are proprietary trade secrets.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. (B) THE RESULTS OBTAINED FROM THE SERVICES WILL BE ACCURATE OR RELIABLE. (C) THE QUALITY OF ANY INFORMATION OR ANALYSIS WILL MEET YOUR EXPECTATIONS. (D) ANY ERRORS IN THE SERVICES WILL BE CORRECTED. VAASTU SHASTRA IS A TRADITIONAL PRACTICE BASED ON CULTURAL AND SPIRITUAL BELIEFS. THE EFFECTIVENESS OF VAASTU REMEDIES IS NOT SCIENTIFICALLY PROVEN AND INDIVIDUAL RESULTS MAY VARY. OUR RECOMMENDATIONS ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT REPLACE PROFESSIONAL ADVICE. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOUNDATIONAL CREATIONS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES. (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES. (C) ANY CONTENT OBTAINED FROM THE SERVICES. (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. (E) ANY DECISIONS MADE OR ACTIONS TAKEN BASED ON THE VAASTU ANALYSIS OR RECOMMENDATIONS PROVIDED. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to defend, indemnify, and hold harmless Foundational Creations, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) Your use of the Services. (b) Your violation of these Terms. (c) Your violation of any third-party rights. (d) Any content you submit or transmit through the Services. (e) Any decisions or actions you take based on the Vaastu analysis or recommendations. This indemnification obligation will survive the termination of these Terms and your use of the Services.

9. Subscription and Payment Terms

Some features require a paid subscription. By subscribing, you agree to: (a) Pay all subscription fees as they become due. (b) Provide accurate billing information. (c) Accept automatic renewal unless you cancel before the renewal date. (d) Understand that subscription fees are non-refundable except as required by law or stated in our refund policy. Prices may change with 30 days' notice. We reserve the right to modify or discontinue subscription features at any time.

10. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination: (a) Your right to use the Services will immediately cease. (b) We may delete your account and associated data. (c) Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Bangalore, India, in English. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.
